Terms of service

These terms of service (the "Terms") govern subscriptions to the NovaResto service, published by Novadesko SRL, a company incorporated under Belgian law, registered with the Crossroads Bank for Enterprises under company and VAT number BE 1018.192.568, with registered office at Rue de Boussoit 4, 7110 Maurage, Belgium. By creating an account, you accept these Terms without reservation.

1. The service

NovaResto is a SaaS platform for hospitality professionals: digital menu, QR table ordering, POS, staff management, reservations, online ordering, recipes, establishment website and events. The exact content of each plan (Starter, Pro, Premium) is described on the Pricing page at the time of subscription.

The service is reserved for professionals acting in the course of their business (B2B). It is not intended for consumers within the meaning of the Belgian Code of Economic Law.

For online ordering and the guest accounts offered on establishment websites, NovaResto acts solely as a technical intermediary: the contract for the sale of food and drinks is concluded directly between the end customer and the restaurateur, who remains solely responsible for the offering, prices, allergen information, preparation, hand-over of orders and collection of payment.

2. Account and establishments

You are responsible for the accuracy of your account information, the confidentiality of your credentials and the use of the service by your team members. Each establishment you create receives an address like {slug}.novaresto.com; you warrant that the chosen name does not infringe any third-party rights.

You remain solely responsible for the content published on your establishment's website (texts, photos, prices, allergens) and for its compliance with the regulations applicable to your business.

3. Free trial

Every new account receives a 14-day free trial, with no credit card and no commitment. When the trial expires, if no subscription has been taken out, features are frozen but your data is kept: you can subscribe at any time to reactivate the service.

4. Prices and billing

Prices are shown in euros, excluding VAT, on the Pricing page. Subscriptions are billed monthly or annually, in advance, through our payment provider Stripe. The Premium plan allows additional restaurants, billed at €20 excl. VAT per month per restaurant, prorated when a restaurant is added or removed mid-period.

Novadesko may revise its prices; any increase is notified at least 30 days before it applies and only takes effect at the next renewal. If you disagree, you may cancel before the new price takes effect.

If a payment fails, a reminder is sent; without settlement within 14 days, access to the service may be suspended until payment.

5. Term, plan changes and cancellation

Monthly subscriptions carry no commitment and renew tacitly each month; they can be cancelled at any time from the BackOffice, effective at the end of the current period. Annual subscriptions renew tacitly each year; they can be cancelled up to the day before the renewal date.

Upgrades apply immediately, with the difference billed pro rata. Downgrades take effect at the next renewal.

After cancellation, your data remains exportable for 30 days, then is deleted in accordance with our privacy policy. No refund is due for a period already started, except where mandatory law provides otherwise.

6. Availability and support

Novadesko uses its best efforts to keep the service continuously available, without being able to guarantee it absolutely. Planned maintenance is, as far as possible, carried out outside restaurant service hours and announced in advance. Support is available by email at hello@novaresto.com.

7. User obligations

You undertake not to misuse the service, in particular: not to attempt to access other accounts' data, not to deliberately overload the infrastructure, not to publish unlawful, misleading or infringing content, and to comply with the regulations applicable to your business (allergen information, price display, taxation, certified cash register where applicable).

NovaResto is a management tool; it does not replace your legal, accounting or tax obligations as a restaurateur.

8. Intellectual property

The platform, its code, its design and its brand remain the exclusive property of Novadesko. You receive a non-exclusive, non-transferable right of use for the duration of the subscription. The content you publish remains your property; you grant Novadesko the licence strictly necessary to host and display it as part of the service.

9. Liability

Novadesko's liability is limited to direct and foreseeable damage and capped, all causes combined, at the amounts paid by the customer during the 12 months preceding the event giving rise to the claim. Novadesko is not liable for indirect damage (loss of revenue, loss of customers, damage to image), nor for interruptions attributable to third parties (host, carriers, payment provider) or to force majeure.

10. Personal data

The processing of personal data is described in our privacy policy, which forms an integral part of the contract. For your guests' data, Novadesko acts as a processor in accordance with Article 28 GDPR.

11. Governing law and jurisdiction

These Terms are governed by Belgian law. Any dispute relating to their interpretation or performance falls under the exclusive jurisdiction of the Enterprise Court of Hainaut, Mons division, unless mandatory law provides otherwise.
